Water Protectors Wade into a Stream Undergoing Construction Activity Still in Litigation

MARENGO, WI – On Monday morning, August 17th, 2026, water protectors put down prayers in the river where line 5 reroute construction threatens to cross our sacred water. Water is life.
On Thursday, August 20 at 9:00 AM, WI Bayfield County Judge John Anderson is scheduled to hear Oral Arguments on the broader challenge to the Wisconsin DNR State permits for the Enbridge Line 5 reroute. An Oral Hearing for the whole Appeal in the consolidated case to overturn Administrative Law Judge Foy’s decision to accept the WIDNR’s approval of Enbridge’s Line 5 reroute permits.
Previously, an Administrative Law Judge Angela Chaput Foy decided that the WIDNR made the proper decision of accepting the Enbridge Line 5 reroute permits, after the 6+ weeks of contested case hearings. Many groups Appealed that decision to the Iron County District Court which was first heard by Judge Anderson on April 16th at the Bayfield County Courthouse in Washburn, WI.
The Public may attend In Person Only at either 117 E 5th St, Washburn, WI 54891 or 300 Taconite St #101, Hurley, WI 54534 courthouses. Judge Anderson will be present in the Washburn Courthouse.
